Terms of use

1. Publisher and purpose

The For the Real (FT Real) service is published by Jules Artale (sole proprietorship — SIREN 813 972 361 / SIRET 813 972 361 00022), Impasse Saint-Louis, 83270 Saint-Cyr-sur-Mer. See the legal notice.

For the Real is a golf coaching service based on video analysis: the student films their swing or their round from the app, submits their videos, and receives a personalized analysis written by a professional coach. The service also includes round and progress tracking, a conversational assistant and a community network (“For Real”).

The service is a sports coaching service. It does not in any way constitute medical, paramedical or rehabilitation advice. If you experience pain or injury, or have any doubt about your physical fitness, consult a health professional.

2. Minimum age

Access to the service is restricted to people aged at least 15. A date of birth is requested at sign-up and an age check is applied: any sign-up declaring an age under 15 is refused.

An account created using an inaccurate age declaration is suspended as soon as it is detected, then deleted if there is no response within 14 days (see article 12 of the privacy policy). Accounts of minor users are private by default.

3. Account creation and security

• You undertake to provide accurate information and to keep it up to date.
• Your account is strictly personal: sharing login credentials is prohibited.
• You are responsible for keeping your password confidential and for any activity carried out from your account.
• Any suspicious use must be reported without delay to privacy@forthereal.app.

4. Subscription, trial and payment

Some features (video submission, coach analyses, advanced statistics, assistant) are reserved for subscribers. The subscription is offered as an auto-renewing subscription, purchased exclusively through Apple’s App Store.

• Prices, durations and any trial periods are shown in the app before any purchase.
• Payment is collected by the relevant store. We never have access to your banking details.
• The subscription renews automatically at the end of each period, unless renewal is turned off at least 24 hours before the end of the current period.
• The subscription is managed and canceled in your Apple or Google account settings.
• Refunds are governed by Apple’s and Google’s terms; requests must be sent to them directly.

Right of withdrawal. For consumers in the European Union, the supply of digital content begins upon subscription with your express consent, which entails waiving the 14-day right of withdrawal for the period already begun (article L. 221-28 of the French Consumer Code).

5. Service commitments

The coach strives to analyze submitted videos every day. This pace is a quality objective and not a guaranteed result; it may vary depending on the volume of requests and on vacation periods, which are announced in the app.

The service is provided “as is”. We guarantee neither uninterrupted availability nor the absence of defects, and we may temporarily suspend access for maintenance or updates. No sports progress, competition result or handicap index change is guaranteed.

6. User content and moderation

You remain the owner of the videos, photos, messages and comments you upload. You grant the publisher a non-exclusive, free license, limited to the applicable retention period, strictly for the purpose of providing the service: storage, display in your account, analysis by the coach and moderation. No external publication (social networks, marketing materials) is made without your separate, documented consent.

You warrant that you hold the necessary rights to the content you upload, including the permission of any identifiable people appearing in it.

The following are prohibited and removed without notice: sexual content or nudity, violent or dangerous content, hateful, discriminatory or harassing content, content infringing image rights or third-party rights, content showing a minor without verified parental permission, and content unrelated to golf.

Each piece of submitted content is reviewed by the moderator. Any user can report content or block a member from the app; reports are handled as quickly as possible. You are notified when content is removed, with the reason; you have 7 days to dispute it at privacy@forthereal.app.

7. Prohibited uses

• Attempting to access accounts, data or administration areas that do not belong to you.
• Extracting, copying or reusing the service’s content on a large scale (scraping, automated harvesting).
• Disrupting the operation of the service, circumventing technical limitations or the subscription check.
• Reselling, sublicensing or commercially exploiting the service or the coach’s analyses without written permission.
• Using the service for unlawful purposes or in breach of these terms.

8. Conversational assistant

The app offers a conversational assistant based on artificial intelligence models. Its answers are provided for information only and may contain errors: they replace neither the coach’s analysis nor professional advice. No decision producing legal effects is made in a fully automated way.

9. Suspension and termination

At your initiative: you may stop using the service at any time, turn off subscription renewal with your store, and delete your account from Profile > My data & privacy > Delete my account, or by following the procedure described on the Delete my account page. Deletion is permanent and results in the erasure of your data under the conditions set out in the privacy policy. It does not entail a refund of the current subscription period, which is managed by the store.

At our initiative: in the event of a breach of these terms — in particular posting prohibited content, age fraud or compromising security — the account may be suspended and then terminated after notification, or immediately in the event of a serious or manifestly unlawful breach. You may dispute this decision at privacy@forthereal.app; a reasoned response will be sent to you within 7 business days.

10. Liability

The publisher cannot be held liable for indirect damage, data loss attributable to the user, incorrect execution of a technical movement, injury occurring while playing golf, or unavailability due to force majeure or to a third-party provider. Nothing in these terms limits the publisher’s liability where the law prohibits it, in particular toward consumers.

11. Changes to the terms

These terms may be amended to reflect changes in the service or in regulations. Any substantial change is notified at least 30 days before it takes effect, by email and/or in the app. If you refuse the new terms, you may delete your account before that date.

12. Governing law and disputes

These terms are governed by French law. In the event of a dispute, an amicable solution will be sought by writing to privacy@forthereal.app. Failing agreement, the dispute may be brought before the competent French courts, without prejudice to the protective rules applicable to consumers.
